    Condo pools opening ????

    We are having a lot of drama over the opening of the pool at our condo complex due to Covid19.
    The biggest concern seems to be that insurance does not cover a lawsuit due to a pandemic. Nobody really believes that it could be proven that a person contracted it at the pool, but the HOA would still have to pay lawyer fees to defend any lawsuit related to the pandemic. I am curious what is happening at other condo complexes.

    1. What complex are you at??
    2. Is the pool(s) open or closed??
    3. What, if anything, is being done differently??
    4. Any special assessments??

    folllowing state suggestions on public pool openings
    No.

    I am the board VP and getting plenty of guff about it but that is the reality, we dont need to chance a lawsuit and will open our pool when KC and STL open their public pools.

    Probably irrelevant but it was announced yesterday that the public pools in Cedar Rapids, IA (I think there are 4-5 of them) will not open at all this summer.

    Lands End pools open tomorrow. Typical distancing stuff and we better not have another special assessment.

    Several of the KC suburbs have already announced their pools will not open at all in 2020

    I agree with Rick, cities not opening public pools is pretty much irrelevant. A condo is a private pool owned by the HOA members.

    I'm guessing the low number of responses to Griff's direct questions is because other complexes are not having the conversation we're having at ours.

    Are Condos Complex closing their elevators or parking lots? People can gather there too!
    Have people sign a form stating they are taking all responsibility by entering the pool & pool area!
    Post signs saying, Due to COVID-19 you are here at your own risk!
    Make the Condo owners responsible for their Family & Guest...

    I am in charge of the HOA of a subdivision that I am developing. It is in Ks though. The governor here says as of now we can open community pools June 1. There are state/county recommended signage that we have already installed. At the time of opening there will be occupancy restrictions. We will need to limit the time each family can spend there. We are in the process of informing the residents of the rules, and that they are accepting the risks if they choose to go. Make sure the HOA is insured. We have informed that our risk is fairly low since we are unpaid members of the HOA and there is no profit motive to opening it.

    We are at Bristol Bay and the pool is open. Think they removed some of the chairs and are doing more cleaning. No special assessment.

    Four Seasons home owner association, has several pools and common areas. They just they would open the pools June 1.

    That is pretty much what people with common sense have said.
    My argument is also why would any anybody try to sue an HOA that does not really have any $$ when they could go after somebody with deep pockets??

    We have insurance but we are being told that no insurance covers pandemics.
    After advisement from an attorney, our BOD believes we'd ultimately win in a law suit but it would still be expensive to defend ourselves.
